MPEP deep dive
·Updated August 2026
Every patent bar question is answerable from the MPEP and its named supplements. But the exam viewer only searches one chapter at a time, and the tested revision lags current law by over two years. Both facts should change how you study.
Rev. 01.2024 is current only as of January 31, 2024. Everything after that date is not tested: the July 2024 subject-matter-eligibility guidance, the February 2024 obviousness guidance, the FY2025 fee changes, and the 2025 discontinuation of Accelerated Examination. The exam grades you against the MPEP, not against current law — study material that "helpfully" updates to current law will cost you points.
A PDF viewer with a chapter dropdown. Open MPEP 700, and Find searches only MPEP 700. No global search, no boolean operators, no index search.
Two independent sources converge on the same number: candidates realistically look up 20-30 of 100 questions across both 3-hour sessions.
A lookup costs 4-6 minutes and must be repaid by banking time on recall questions. Answer the straightforward ones first; defer the long fact patterns.
Because lookups are scarce, the highest-value skill is a topic → chapter → section map — knowing that after-final practice lives at 714.12-714.13 before you open the dropdown. Recall of the rule's address beats recall of the rule's text.
Ninth Edition, Revision 01.2024. The USPTO names the tested revision in its source-materials document — check it before relying on any prep material, because vendors lag revisions.
No. The testing software opens one chapter at a time from a dropdown, and its Find button searches only the open chapter. There is no global search, no boolean, no index search.
No. Rev. 01.2024 is current only as of January 31, 2024. The 2024 eligibility guidance updates, FY2025 fee changes, and later rule changes are not tested. Answer per the MPEP, even where current law differs.
Independent sources converge on 10-15 lookups per 3-hour session — 20-30 of 100 questions total. At 3.6 minutes per question, every lookup must be repaid by fast recall answers elsewhere.
A dated plan over the tested revision, with chapter-map drills for the 70-80 questions you will answer without a lookup.
