The USPTO names the MPEP and three separate references in its examination source list. These federal documents are free to read. Check the list during your examination window for changes.

What is the patent bar pass rate?
Stable at 45-49% over the last five fiscal years per USPTO statistics — FY2025 was 46% across 2,278 administrations. Roughly half of all takers fail.
Is the patent bar open book?
Yes. The examination provides the designated reference materials on screen. The MPEP viewer searches one chapter at a time. USPTO allows six hours for 100 questions and sets no lookup quota. Practice both applying rules and finding their sections within the time limit.
Which MPEP revision does the exam test?
Ninth Edition, Revision 01.2024, current through January 31, 2024, plus the other references on the USPTO examination source list. When a designated policy or procedure reference conflicts with the MPEP, that reference controls. Check the current source list during your examination window.
How long does patent bar prep take?
Common guidance is 150-300 hours over 2-4 months. The full corpus is ~35,000 minutes of reading, which no one does linearly — a weighted plan over the heavily-tested chapters is the only realistic route.
Do design patent practitioners take a different exam?
No. Since January 5, 2024 the USPTO admits design-only practitioners, but they take the same registration exam — only the scientific/technical eligibility requirements differ.
What does the exam cost?
Fees are set in the General Requirements Bulletin and change with USPTO fee cycles — verify the current application and exam fees at uspto.gov before applying.
