# The MPEP — What the Patent Bar Actually Tests, and How to Study It

## Use the designated examination sources

Rev. 01.2024 is current through January 31, 2024. Study it with the other references on the [USPTO examination source list](https://www.uspto.gov/sites/default/files/documents/registrationexamsourcematerial.pdf): the Consolidated Trial Practice Guide, the 2013 representation rules, and the Global/IP5 PPH notice.

Under [GRB section IX.A](https://www.uspto.gov/sites/default/files/OED_GRB.pdf#page=25), a designated USPTO policy or procedure reference controls when it conflicts with the MPEP. Check the source list during your examination window. Later practice changes are not automatically tested.

## What "open book" actually means at Prometric

### The trainable skill: the address, not the text

A topic → chapter → section map helps you find relevant rules. For example, after-final practice appears at 714.12-714.13. Practice finding a rule and applying it to the facts in the question.

## MPEP questions

Which MPEP edition is on the patent bar right now?

Ninth Edition, Revision 01.2024. The USPTO names the tested revision in its source-materials document — check it before relying on any prep material, because vendors lag revisions.

Can I search the whole MPEP during the exam?

No. The testing software opens one chapter at a time from a dropdown, and its Find button searches only the open chapter. There is no global search, no boolean, no index search.

Which sources control when the MPEP and other guidance differ?

Use Rev. 01.2024 and the other references on the current USPTO examination source list. A designated policy or procedure reference controls when it conflicts with the MPEP. Later changes to patent practice are not automatically added to the examination sources.

Does the examination limit how many questions I can look up?

USPTO sets no lookup quota. Each session allows three hours for 50 questions, an average of 3.6 minutes per question. Use timed practice to measure your own reading, reasoning, and lookup pace.
