Terms of Service

These Terms of Service (“Terms”) govern your access to and use of exclam.ai (the “Service”), operated by the exclam.ai team (“we,” “us,” or “our”). By creating an account, accessing, or otherwise using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

Previously, the Service was offered at savantapp.com. These Terms govern your use of the Service at exclam.ai and any legacy domains that redirect to it.

1. Eligibility and accounts

You must be at least 13 years old to use the Service (16 in the EEA/UK). You’re responsible for the activity on your account and for keeping your credentials confidential. Notify us at [email protected] if you believe your account has been compromised.

2. Your content

You retain ownership of the materials you upload (PDFs, notes, slides, flashcards, quizzes, study plans, etc.) (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, store, copy, process, transmit, and display Your Content only to operate, secure, and improve the Service for you. We don’t sell Your Content.

You represent that you have the rights to upload Your Content and that it doesn’t infringe anyone else’s rights or violate any law. Don’t upload material you don’t have the right to use.

3. AI features and outputs

The Service uses large language models and other AI systems to generate summaries, flashcards, quizzes, study guides, and study plans (“Outputs”) from Your Content and our curated material. Outputs may be inaccurate, incomplete, or out of date. You’re responsible for reviewing Outputs before relying on them — especially for exam prep, medical, legal, financial, or other consequential decisions. Outputs are provided “as is” and don’t constitute professional advice.

4. Acceptable use

You agree not to:

  • Use the Service to violate any law or third-party right;
  • Upload copyrighted material you don’t have the right to use (including pirated textbooks, official exam questions under license, or other restricted material);
  • Reverse engineer, scrape at scale, or attempt to extract our model weights, prompts, curated content, or training data;
  • Resell, sublicense, or expose the Service (or Outputs at scale) to third parties without our written permission;
  • Interfere with the Service, probe for vulnerabilities outside our reporting channels, or attempt to disrupt other users;
  • Use automation that materially exceeds the limits posted in the Service.

5. Plans, payments, and refunds

The Service offers a free tier and paid plans (collectively, “Plans”). Paid Plans renew automatically until canceled. You can cancel anytime in account settings; cancellation stops future renewals but doesn’t refund the current period unless required by law. Prices, features, and limits may change with reasonable notice for the next billing period.

6. Beta features

We sometimes release features marked “beta,” “preview,” or similar. Those features are provided as-is, may change or be removed, and may have additional usage limits or stability issues.

7. Our intellectual property

The Service, including its software, UI, brand, curated content, and documentation, is owned by us and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for your personal study (or, for paid Team plans, for the named team members) consistent with these Terms. Outputs you generate from Your Content for personal study are yours to use; outputs generated from our curated content may not be redistributed outside the Service.

8. Termination

You can stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if your use poses a risk to the Service or other users, or if we’re required to do so by law. We’ll give reasonable notice where practical. On termination, Your Content may be deleted after a wind-down period; export your data first if you want to keep it.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DON’T WARRANT THAT THE SERVICE OR OUTPUTS WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT THEY’LL HELP YOU PASS A SPECIFIC EXAM.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER. WE’RE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR EXAM OUTCOMES.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising out of Your Content, your violation of these Terms, or your violation of any law or third-party right, except to the extent caused by our gross negligence or willful misconduct.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll notify you in-product or by email. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Disputes will be resolved exclusively in the state or federal courts located in Delaware, unless your local consumer-protection laws require otherwise.
